1. Introduction and Legal Overview

These Terms & Conditions govern the provision of training services by N5 Academy, a professional Health & Safety and First Aid Training Academy based in the United Kingdom. They set out the contractual relationship between N5 Academy and any individual, employer, organisation, parent, guardian, or third party who books, attends, accesses, or participates in any training delivered by us.

By booking a course, enrolling on a programme, attending training in person, accessing online learning materials, or otherwise engaging with our services, you confirm that you have read, understood, and agreed to be legally bound by these Terms & Conditions. These Terms are intended to be clear, fair, and transparent, in line with UK consumer protection law and recognised training industry standards.

These Terms apply to all training services provided by N5 Academy, including but not limited to classroom-based training, onsite and in-house group training, and online or blended learning courses. They are designed to protect both learners and the Academy, reduce misunderstandings, and set clear expectations around bookings, payments, attendance, assessments, certification, and conduct.

N5 Academy delivers a wide range of professional training services across the UK, including first aid training in London, health and safety training in the UK, workplace safety courses, paediatric first aid training, fire safety training, traffic marshal and banksman training, safeguarding courses, and basic life support training. All courses are delivered in accordance with current UK guidance and recognised best practice.

If you do not agree with any part of these Terms & Conditions, you should not proceed with a booking or access any training materials or services provided by N5 Academy.

2. Definitions and Interpretation

For the purposes of these Terms & Conditions, the following definitions apply:

  • Academy, We, Us, Our refers to N5 Academy.
  • Learner refers to any individual attending, participating in, or accessing training.
  • Client refers to an employer, organisation, school, nursery, local authority, or third-party booking for training.
  • Course refers to any training programme, qualification, or learning activity offered by N5 Academy.
  • Booking refers to the reservation of a place on a course, whether for an individual or a group.
  • Online Course refers to any digital, remote, or e learning programme provided by the Academy.
  • Certification refers to any certificate or confirmation of completion issued upon successful course completion.

References to legislation include any amendments, updates, or replacements that are in force at the relevant time. Headings are used for ease of reference only and do not affect interpretation.

3. Scope of Training Services

N5 Academy is a UK first aid training provider delivering both regulated and non-regulated training aligned with current UK legislation, guidance, and industry standards. Our courses are designed to meet recognised requirements set by bodies such as the Health and Safety Executive, Ofsted, EYFS, and relevant awarding or accrediting organisations where applicable.

Training services may include, but are not limited to:

  • First Aid at Work and Emergency First Aid at Work
  • Paediatric First Aid and Emergency Paediatric First Aid
  • Basic Life Support and CPR training
  • Safeguarding Children and Safeguarding Awareness Courses

The content, structure, duration, delivery method, assessment approach, and certification requirements may vary depending on the specific course, learner group, and regulatory framework. Course details are provided at the point of booking and form part of these Terms.

4. Booking Process and Course Availability

4.1 How to Make a Booking

Bookings may be made through our website, by telephone, or via email. A booking is considered provisional until payment has been received in full or written confirmation has been issued by N5 Academy. We reserve the right to decline or cancel bookings where required information is not provided or eligibility criteria are not met.

For onsite, in-house, or group training, a written quotation or agreement may be issued outlining the scope of training, number of learners, location, dates, pricing, and any specific requirements.

4.2 Course Availability and Minimum Numbers

All courses are subject to availability. N5 Academy reserves the right to set minimum and maximum learner numbers to ensure training quality, effective learning, and health and safety compliance. Where minimum numbers are not met, we may reschedule or cancel a course.

4.3 Accuracy of Booking Information

The booking party is responsible for ensuring that all learner information provided is accurate, complete, and up to date. This includes names, contact details, and any relevant prerequisites. Errors or omissions may delay course access, assessment, or certification.

5. Fees, Pricing, and Payments

5.1 Course Fees and Pricing Structure

Course fees are clearly displayed at the time of booking or confirmed in writing for group bookings. Prices may vary depending on course type, delivery format, location, duration, and group size. Unless otherwise stated, fees include training delivery, assessment, and certification.

5.2 Payment Terms

Payment is required in advance of course attendance unless a written agreement has been made with N5 Academy. Accepted payment methods may include debit card, credit card, bank transfer, or invoicing for approved business clients.

Failure to make payment by the agreed deadline may result in cancellation of the booking or refusal of course access.

5.3 Late or Outstanding Payments

Where payment remains outstanding, N5 Academy reserves the right to suspend access to training materials, withhold certificates, or take reasonable steps to recover unpaid fees.

6. Consumer Rights and Distance Selling Regulations

When courses are booked online, by telephone, or by email, learners and consumers are protected under the Consumer Contracts Regulations. This provides a statutory cooling-off period of 14 days from the date of booking for most services.

The cooling-off period may not apply where:

  • The course takes place within 14 days and has been fully delivered
  • Online or digital learning content has been accessed with the learner’s consent

By accessing online learning materials immediately after booking, learners acknowledge that they may waive certain cancellation rights under distance selling regulations.

7. Cancellations, Transfers, and Non-Attendance

7.1 Learner Cancellations

If a learner is unable to attend a booked course due to illness, personal circumstances, or unforeseen events, N5 Academy should be informed as soon as reasonably possible. Depending on notice given, options may include transfer to a future date, credit, or partial refund.

7.2 Late Cancellations and Non-Attendance

Failure to attend a course without prior notice, or cancellation within a short notice period, may result in the full course fee being forfeited. This reflects venue, trainer, and administrative costs already incurred.

7.3 Employer and Group Bookings

For employer or organisation bookings, specific cancellation and transfer terms will be outlined in the booking agreement. Minimum numbers and notice periods apply, and reductions in learner numbers may not reduce the agreed fee.

8. Course Changes and Cancellations by N5 Academy

N5 Academy reserves the right to cancel, reschedule, or amend courses where necessary, including due to trainer illness, venue issues, low enrolment, or circumstances beyond our control. Where possible, learners will be offered an alternative date or a refund.

We will not be liable for additional costs incurred by learners, such as travel or accommodation.

9. Learner Responsibilities and Conduct

Learners are expected to behave in a professional and respectful manner at all times. This includes arriving on time, participating fully, following trainer instructions, and respecting other learners.

Learners must comply with all health and safety instructions. Disruptive, abusive, or unsafe behaviour may result in removal from the course without refund and without certification.

10. Health, Safety, and Fitness to Train

Many courses include practical elements that involve physical activity. Learners are responsible for ensuring they are medically fit to participate. Any medical conditions, injuries, or additional needs that may affect participation should be disclosed in advance.

N5 Academy reserves the right to exclude learners from practical activities where participation may pose a risk to themselves or others.

11. Assessments, Competency, and Certification

11.1 Assessment Requirements

Courses may include practical assessments, written assessments, multiple choice tests, or ongoing observation. Learners must meet the required standard to be deemed competent.

11.2 Certification and Validity

Certificates are issued only upon successful completion of all required elements of the course. Certificates may have a defined validity period, after which refresher training may be required.

N5 Academy reserves the right to withhold certification where assessment standards are not met or where these Terms have been breached.

12. Online Learning and Digital Access

Online courses and digital learning platforms are provided for individual use only. Login details must not be shared. Access may be time-limited and subject to fair use policies.

Learners are responsible for ensuring they have suitable equipment, software, and internet access. Technical issues on the learner’s side do not constitute grounds for refunds.

13. Intellectual Property and Training Materials

All training materials, content, presentations, videos, and resources remain the intellectual property of N5 Academy. Materials may not be copied, recorded, shared, or distributed without prior written consent.

14. Data Protection and Privacy

N5 Academy processes personal data in accordance with the UK GDPR and the Data Protection Act 2018. Personal information is collected and used for training administration, certification, legal compliance, and quality assurance.

15. Safeguarding and Duty of Care

N5 Academy is committed to safeguarding children, young people, and vulnerable adults. Safeguarding concerns should be reported immediately to the trainer or Academy management and will be handled in line with safeguarding legislation and best practice.

16. Complaints, Feedback, and Appeals

Learners have the right to raise complaints or appeals regarding training delivery, assessment decisions, or conduct. Complaints should be submitted in writing and will be investigated fairly, transparently, and within reasonable timescales.

17. Liability and Insurance

N5 Academy holds appropriate public liability and professional indemnity insurance. Our liability is limited to the maximum extent permitted by law and does not exclude liability for death or personal injury caused by negligence.

18. Force Majeure

N5 Academy shall not be liable for failure or delay in delivering training services due to events beyond reasonable control, including extreme weather, pandemics, industrial action, or government restrictions.

19. Amendments to Terms & Conditions

These Terms & Conditions may be updated from time to time to reflect changes in law, guidance, or business operations. The latest version will always be published on our website and will apply to future bookings.

20. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of England and Wales. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
